and we are learning a little bit more about the suspect's past. apparently, he has been convicted of rape before. he was released from prison in december for serving time in a similar case. 31-year-old edward rodriguez is his name, police say. he was on a g.p.s. device as part of his probation. he served about eight years in prison for raping a woman about ten years ago. he's now accused of raping a woman in the south enderle tuesday morning. when police say rodriguez rode up to her on a bicycle and said he had a knife. he forced her into a park about two tents of a mile away and raped her. rodriguez finished serving about eight years back in december, and police say, he was on probation when he committed this crime. >> he was on a g.p.s. bracelet. from all the information we have, he cut that bracelet off and that's why we weren't able

wanted to. >> the reporter: now, police telling us they do believe he had the bracelet on at the time of the crime, but he did take it off after the crime, and they did find that bracelet and then all afternoon, they were able to track him down. they went to about 10 or 12 addresses throughout the city, but they did find him. we are live if boston, robert goulston, fox 25 news. >> mark: and there is more breaking news tonight in brighton, where a person was badly hurt when a tree branch fell on them of them on commonwealth avenue. working in that area all day. fox 25's john monahan is live on the scene and you are learning more about the man who was hit by that branch. >> the reporter: we are mark. he is in the hospital, being surrounded by family and is in surgery at this time, but take a look, if you go through the fence, we can get a look at a log, a piece of wood that's about the same size police say as the piece that hit this man, about 30 inches long and a foot in diameter. it's not clear if this is the piece, but it is taped off and

another part of the investigation is looking in to this hole in the fence. the trees have grown true it. part of the reason they're trimming back the trees. the man may have possibly cut through the fence, the tree crews on the other side may not have seen him and that's part of what police are looking at, as the workers were trimming the trees, it's not clear that they did see him at all. take a look at the video shot earlier. at last check, the man who was hit by the branch was in surgery at beth israel hospital. police tell us his family is with him as i said, and police also say they have the alleyside blocked off, the tree crew, but not the fence side. they say the belmont tree service was trimming trees for hamilton realty company this morning, since about 7:00 a.m. and about 3:00 p.m., the man who works for herb chambers on comm. avenue was somehow hit by a falling branch. the piece of wood was 30 inches long, a foot in diameter.

tells fox 25 that his friend came back to tell her what happened. >> his friend, who actually was here with him, getting a sandwich, he came back to tell me what happened to the guy. so i was in shock when he told me that, because they left the store, like probably 30 minutes, 45 minutes after that happened. >> and you were talking something -- >> the reporter: now, another man who was working nearby heard the commotion, ran over and tells fox 25, he saw that victim under a branch, leaves and limbs. and that he was not moving at the time. he was since taken to beth israel and in surgery right now. take a look, that's the hole in the fence that police are looking into whether or not the man cut through. he worked for herb chambers. he's been taken to beth israel. last check, he was in surgery in serious condition. live in brookline on the brighton line, john monarchs fox 25 news. >> mark: also breaking at 6:00 p.m., the f.a.a. is now investigating why a small plane made an emergency landing on a sand bar in the quabbin reservoir.

salem. in the last ten minutes, the f.a.a. confirmed for us that this is an experimental sea wind aircraft. the pilot not hurt, and made the call to alert state police. now the quabbin is the largest inland body of water in our state, and is the primary water supply for the city of boston and 40 other communities. >> elizabeth: police are still releasing little information about a scaffolding accident that left one man hurt. boston fire confirms for us that a man fell three stories from the scaffolding at harvard we're hearing he was rushed to the hospital about serious injuries. crews have been working on renovations at that building on shaddock street in buries. >> mark: also tonight, firing back. former senator scott brown is blasting accusations that he was one of several people who sexually harassed an anchor at fox news. >> you know, i've never touched her around her waist, in a lunch line, why would i do that? >> mark: in the lawsuit, the now former fox news anchor compared

playboy mansion." new at 6:00 p.m., brown's wife is defending her husband tonight. >> the reporter: gail hough and scott brown have been married for 30 years, the last of which they spent here in new hampshire and tonight, they are both defending brown to fox 25, cameras presenting a united front against these allegations. >> came so far out of left field. >> the reporter: moments after learning he was named in a new lawsuit, we caught up with former senator scott brown on his way to fox news headquarters. >> there were never any issues brought to my attention by her or management at any time whatsoever. >> the reporter: one of brown's former co-hosts, andrea tontaros has named him and others in a lawsuit alleging sexual harassment. tontaros stays brown made sexually expressive comments and touched her around the waist and said she would be fun to go to a night club with. >> i haven't been to a club since 1980 something.

gail hough went farther than that when asked about tontaros's claims. >> to be charged like this in a public forum is out rainous and should be illegal. what is happening here is nothing less than a witch hunt. >> the reporter: hough said while the allegations would be upsetting to any wife, she says, she's never had any reason to question that her husband's behavior is anything less than professional. >> and i'm sorry. i'm sorry for scott and i'm sorry for other people this, for no reason. no reason. >> the reporter: and brown is in fact, so adamant that he said he is ready and willing to go to court and put his side of the story on league record. we reached out to fox news executives for their comment about this lawsuit. they have not yet gotten back to us. live in new hampshire, katherine burcham, fox 25 news.

loud, you know, word i wouldn't repeat in front of my kids. >> elizabeth: tom brady now seems to be doing just fine after accidentally cutting his thumb with a pair of scissors, forcing him off the field at last week's preseason games. this is the first time now that we're hearing from brady about the accident. sports director tom leyden is here now and tom brady addressed the scissors situation as you could say, but he said nothing about why he missed the last two practices. >> he simply said he had to take care of something and that was the end of information about brady's two day absence, but we did garner insight regarding the training sequence of events that led to him leaving gillette stadium before thursday's game against the barrels. brady was back on the practice field working out with his teammates as they gear up for friday's game against the carolina panthers. that thumb did not seem to have any effect on what brady was doing today. as for last thursday, bad luck as the franchise qb fumbled some scissors, and here's the explanation.

connected with strong arm tactics. eric rasmussen is live at city hall, where he found out kelly's job description is changing and he's about to make a lot more money. eric. right, ock, fox 25 investigates just got the amended contract this afternoon. it's doubling the $200,000 deal we first reported back in may. kelly is getting this increase, even though his first investigation found no city employees did anything wrong right before two of them were federally indicted. former federal prosecutor, brian kelly, who helped take down whitey bulger, could now make as much as $400,000 for his advice at boston city hall, according to the latest version of a contract obtained by fox 25 investigates, signed earlier this month by mayor marty walsh. i feel very good about his work. i feel confident in the work he's done. kelly's original contract with the city was just $50,000 when he was brought on last fall.

february, and now, $400,000. the mayor hired kelly to investigate his administration, after several teamsters were charged with extorting the crew of top chef to use union labor. kelly's first investigation found no city employees did anything wrong. but months later, the city's director of tourism, sports and entertainment, kim burr set and another staffer, tim sullivan, were charged with extortion. >> this is a find any and you had two staff members indicted. why keep him on for the job. >> they're indicted on alleged allegations. at the end of the day, we will know when the court is complete who was correct, if anyone was correct in the case. kelly's rate of $625 an hour hasn't changed. but his consulting duties will now include advising a new committee, charged with stream rhining the city's -- streamlining the city's permitting process. in a statement to fox 25, kelly would only say i'm going to

the family of this 26-year-old woman desperately trying to figure otis epps what happened with when she fell out of a party bus window and died. the manager at the bus company said his company didn't do anything wrong. >> elizabeth: tonight for the first time, we're hearing from the woman's devastated family and friends. crystal haynes joins us live. they told you they're really not trying to blame anyone. >> the reporter: tracey's sister told me that the friends on that party bus tried to save her life when she fell out of the window, but just couldn't. this could have happened. >> she was always smiling, she was very kind, loving, family oriented. it was the night of -- a night of getting together, lots of friends, and turned out into a tragedy. >> the reporter: gabriellea is trying to focus on how her sister lived, rather than how she died. 26-year-old tracey was at a bachelorette celebration whether she fell out of an emergency

trooper monaco will be in court on thursday. >> mark: dozens of t station janitors are being laid off. the transit system signed contracts with two companies, eliminating nearly 60 positions. the t will pay $13.5 million a year for cleaning services. the contracts will save the agency more than $4 million per year. union leaders say the cuts will create sweatshop-like conditions for workers who are not laid off. >> elizabeth: more than 24 after ar tornado passed through the area, cleanup crews are in the area. the tornado left a path of destruction a mile wide long. lexington homeowners are dealing with insurance companies as reality sets in. >> i think i realized i was probably in shock yesterday, because i was like, oh, it was all the excitement and all the cars and talking to people. i'm feeling a little overwhelmed. >> elizabeth: tonight police are warning people to look out for

most part. couple of lower 50's off to the north and west. your beach temperatures in the afternoon will be gorgeous. check this out, wollaston, 90 tomorrow afternoon. hampton beach, 87. no matter where you're going, from the new hampshire seacoast all the way to cape cod, it will be sunny tomorrow, just no difference except for a slight difference in temperatures. 80's out here, upper 70's out on nantucket. when you go inland and off to the north and west of cape cod, you're getting up to 90 degrees plus, in some locations, particular valley. boston area, close to 90 degrees. you saw that wollaston temperature at 90. winds off the water from the southeast, now they're going to be coming from the south, so south and southwest, will bring in milder air, but also higher humidity, all ahead of a cold front pushing our way. some showers, some clouds pushing along the front thursday afternoon, dipping into new england, and then some showers for friday morning here in southern new england, so looks to merrimack valley like we'll stay dry thursday night for any

it may not be for everyone. this will be more fine tuned as we get closer to it. futurecast data going out a few days, so it's not as fine tuned in a closer in forecast. this is the best idea of when the showers will be coming on through with this front, but also by the afternoon, any last showers pushing offshore, sunshine and warmer weather. this was fiona, it's really the last time we'll talk about. fiona is not much of anything right now. but gaon track of gaston -- an eye on, although the track of gaston will take it farther out to sea. you'll see a swirl that's materializing in here. the clouds extend to the north as well, but all of the different computer charts have a little different read on them. first of all, gaston, going from here, 65-mile-per-hour winds, a strong tropical storm, becoming a hurricane, cat 1 to cat 2 by the end, this takes you to sunday afternoon, well to our e but check out this other storm. remember, i'm saying there's a

boston red sox, there have been a lot of changes and improvements to fenway park, and it's no surprise, the team is planning more just in time for next season. the changes need to be approved by the landmark's commission, boston's preservation agency, the team's architect made his pitch to the commission about an hour ago, here inside city human services. the proposal includes six projects, including moving the dugouts forward to add more seats behind and around pesky pole in right field with a sturdier identical looking pole and replace the big cumberland park signs in 68 with a giant video screen. the commission took public comments, only two people spoke, both red sox fans, both expressed concerns about the proposed changes. >> i'm not really against 21st century technology. but i still want fenway to be

>> mark: if you're just joining us at 6 '30s p.m., we continue to follow breaking news from boston. a convicted rapist who just got out of jail in december is under arrest again, accused of raping and robbing another woman in boston's south end. >> elizabeth: commissioner bill evans announcing the arrest in the past hour. at bpd headquarters and robert, police say the man was wearing a g.p.s. tracking bracelet, but apparently he had cut it off. >> the reporter: elizabeth, police believe he had this tracking device on when he committed the crime. that's actually how they were able to figure out that he was in the area where this crime happened, but somehow, he was able to get that g.p.s. bracelet off, but tonight, the entire community is relieved after hearing from the boston police commissioner. >> we want to announce an

woman who was raped in boston's south end. end. the 31-year-old man rodriguez was a convicted rapist and on a g.p.s. devision when police say he committed this crime. police say he approached a woman early tuesday morning, she was walking alone when police say rodriguez rode up to her on a bicycle and said he had a knife. he forced her to park about 2/10 of a mile away and rape her. rodriguez was released in december from prison after se almost identical crime. >> he had served crime from what i understand for a similar offense and he was let out of prison in december, you know, he was on a g.p.s. bracelet. from all information we have, he cut that bracelet off, and that's why we weren't able to locate him as quick as we wanted to. >> the reporter: and boston police were able to arrest rodriguez this afternoon around 3:30 p.m., after going to

>> the reporter: elizabeth and mark, we just finished reading that 11-page document. in that document, it states that victim here is a 13-year-old girl and one of the sexual assaults allegedly happened here at the church. now that 13-year-old girl apparently had such a hard time telling detectives exactly what happened. we have a mug shot of that former pastor, here he is. so here is what we have learned within the last hour and a half. manchester police tell us they were tipped off about steven jesmer months church. last night, jesmer turned himself into police. he was charged with three counts of aggravated sexual assault and one count of witness tampering. jesmer is accused of sexually assaulted a 13-year-old girl at her house and at the dialogue church. the assault allegedly happened in june. that girl later told her friend what happened and on another occasion, someone saw her getting out of jesmer's car. jesmer is a husband and a father of two young girls.

neighbors tell us, they always see the girls jumping on the trampoline and seem like a really happy family. >> they'll play basketball and you know, we'll just say hi. >> i wouldn't have never known. >> does it shock you? >> it shocks me, because it's like, you would never know. >> who your neighbors are? >> you don't know. >> he sealed like a family person. -- seemed like a family person. >> what makes you say he's a family person? >> because he's with >> also in the document, in the search warrants, another pastor says he was approached by jesmer, saying jesmer described his actions as stupid, that he crossed the line. the pastor stated that he never directly asked jesmer for details, so he did not know exactly what happened. now, back out here live, jesmer has been fired from his job. tonight, investigators are trying to figure out if there are more victims out there. we, of course, will continue to

evening and cape cod, 70 down through the 60's and holden, notice the temperature not dropping as much as last night, because the winds are shifting. how hot that will make us tomorrow just ahead. >> elizabeth: new electronic tolls really take a toll on drivers? >> mark: last night, we first told you about the open road tolling system. tonight, we break down the numbers. >> elizabeth: the state's plan will ease traffic, but the question here is at what cost? fox 25's blair miller looked into it. >> the reporter: few argue the need to get rid of these on the mass pike, but when the october, some drivers say they won't be pleased. >> people are being pushed further and further and further outside of the city especially in regards to the housing crisis, so i guess i'm concerned about how that's going to affect young people and people who are low income. >> the reporter: it all comes down to one of these -- if you have an e-z pass transponder, it might actually cost you less to use the tolls, but if you have no e-z pass, you'll definitely pay more. here's an example of what you might pay under this proposal.

from exit 13 in natick to exit 18 alston brighton. instead of stopping at toll booths, you would pass under three tolls monitoring your drive. a driver with an e-z pass would pay $1.65, which is less than they do now, but a driver with no e-z pass, would pay $3.65, including a 60-cent billing fee. >> it's not easy to implement, but it's something we need to do. >> the reporter: braintree mayor joe sullivan sits on its transportation department board. while he supports the change, he's also period, so that drivers without a transponder are allowed to ease into it, and not face costs until next year. i think we need to be a little more sensitive to the motorists, despite our best efforts in terms of public notification. there are going to be some who will not have a transponder and we shouldn't be penalizing them just because they weren't ready to go specifically on that day. if it's handled, misimagined at the start, it will be a challenge to overcome that. another issue, the state at one point said they would be

>> mark: banning everything but driving behind the wheel. today, the national highway traffic safety administration posted documents that call for a ban on phones, evens hands-free devices in hopes of eventing distracted driving. it would mean no talking, no dialing, no texting, or suffering the -- surfing the web. >> elizabeth: at george colli reports, the federal guidelines posted today were all a big mistake. >> the reporter: new guidelines advocating a ban on erroneously to a federal web site, a spokesman for national highway traffic safety administration, what appears to be new guidance from the agency is in the on-line federal registry, they recommend all 50 states implement a ban on all cellphones and hand held devices while driving, including the use of hands-free technology, or when stopped at a traffic light. >> distracted driving presents a serious risk for everyone on the road.
